I figure I might as well order one and see what happens. I figure the worst that can happen is that they'll charge my credit card for the full amount making me go over my credit limit just enough to not get declined but charge me a fee, then they'll ship me a rio central, and expect me to pay to return it before issuieing a refund on my maxed out credit card. But you've got to take risks in life, right?

Just for the reccord, I don't expect it to go through, but don't want to be the one who gets stuck without a $6.01 rio central when everyone else gets one.

I'm a big spender and ordered 4 of them. If it is the wrong price I don't think that they can charge more than that without notifying us first, they just wouldn't ship it and cancel the order. If I'm wrong then I'm in big trouble and will ship them back.

I just checked my credit card and it has a temporary amount to Sonic Blue for $24.04

Something similar happened with some ipaq's recently on another website. They apparently can decline sale, but then again that was a british site covered by british law. Maybe it's different in the US.

Surely once they have accepted the order then its legally binding?

There was a case involving this recently with Amazon. The finding was that there's no contract until both parties have agreed. Offering something at a particular price does not constitute acceptance of an offer to buy at that price.

At least in Amazon's case, IIRC, they state (fairly clearly) that there is no contract until they've actually despatched the goods.

So, this is not legally binding. You might get lucky.

Obviously, IANAL and I'm not speaking for SONICblue's estore.

In the amazon.co.uk case the order acknowledgement doesn't mean that they have agreed to sell it to you at that price. Their terms and conditions clearly state that the contract doesn't start until they charge your credit card and ship the goods.

Probably is. I'll be very interested to hear if anyone gets issued a tracking number.

As for whether this was a mistake (or disgruntled employee), you'd think they would have listed it under clearance items if they were simply trying to reduce inventory. Still, if they had wanted to get rid of the last few without a hassle, this would have been a quick way to do it.

I can't find anything on the SB site that states that the order is only accepted when shipped. It does state that my cc will not be charged until after shipping, which may be an attempt to mitigrate such 'problems'.

However, I have a printout of my order confirmation. It contains an Order Number and the phrase "Completion Date: 4/30/2003 5:03:00 AM PST". It also indicates that my payment information has been routed and processed, and furthermore, states "Thank You For Your Purchase". I don't know what the "Web Authorization Code" is or hence what bearing it may have, but everything else indicates to me that my order has been *accepted* by SonicBlue, and nothing on the web site expressly states otherwise.

The National Conference of Commissioners on Uniform State Laws (NCCUSL) adopted the UETA on July 29, 1999. The UETA's purpose is to provide a uniform national framework governing use and application of electronic transactions. First enacted in California, the UETA had been enacted by ten states by April 24, 2000, and fifteen other jurisdictions had legislation pending.

The act defines the terms "record," "electronic record," and "electronic signature" and provides as a general rule that electronic records and signatures satisfy legal requirements that a record be in writing or signed. The UETA also applies only to transactions between parties when each has agreed to conduct transactions by electronic means. Some types of transactions will be exempt. Although the UETA is intended to have broad application, laws governing the creation and execution of wills, codicils, or testamentary trusts and, if desired by the enacting state, transactions governed by the Uniform Commercial Code (UCC) or the Uniform Computer Information Transactions Act (UCITA) will be excluded from the statute's affect.

The UETA contains provisions governing provision or transmission of information in electronic form, attribution of electronic records and signatures, distributing risk of error in electronic transmissions, and retention of "original" electronic records. Other provisions govern automated electronic transactions or the use of so-called electronic "agents" and acceptance of electronic records and signatures by governmental agencies.

The UETA also creates a form of electronic negotiable instrument, called a "transferable record." As long as an entity has "control" of the transferable record, it is a holder of the record as defined by UCC § 1-201(20) and has the same rights and defenses as a holder of a negotiable instrument or document under UCC Articles 3, 7 and 9. The requirements of delivery, possession and endorsement are eliminated. A person has "control" over the record if "a system employed for evidencing the transfer of interests in the transferable record reliably established that person as the person to which the transferable records was issued or transferred." This requirement can be met by a system that creates, stores, and assigns the transferable record in a manner that satisfies six specific conditions enumerated in the UETA.

Since SB are in California, they are subject to this. As I understand it, that means that any email or web-receipt such as those above are legally acceptable.

If this actually works (and I still doubt it immensely, since there is probably a disclaimer on the site somewhere that they are not liable for errors or typos), then I (and probably everyone else) will be going through for people who need them.

It does occur to me, however, that SB are bankrupt. The company still exists, but you might have difficulty bringing suit against a bankrupt company, should they decide not to honour this "offer". At the very least, you'd have to get in line behind everybody else.

Yes, that occurred to me too. But IIRC, we'd be getting in line *with* everyone else, not *behind* them. Goods owed, legitimate creditor. We're one above the shareholders

But of course, as a bankrupt company, they'd probably only have to make good on a percentage of the cost of goods rather than the goods owed. So maybe 10% of 5c....

Ditto. I tried to order some for myself (one for me, one for my parents, one as a backup), and the web site had inexplicable problems digesting my credit card. And, of course, they're also out of stock.

If any of you actually get some of these things, I'd love to get one or two of them. (My parents, in particular, could really use this thing, since I can't seem to convince them to buy a new-enough computer to do ripping on their own.)

Man, I wish I had stayed up later last night. If anyone actually gets them and wants to unload one I'LL BUY IT!

But I'd be seriously surprised if SB actually ships them. The funny this is, though - if SB is going to refund all of your credit cards rather than honor the sale - it will probably cost them more in fees to do that than they will be refunding. I have a feeling some poor web programmer is in deep trouble right about now. Or maybe it was the DBA.

Yup, that's exactly what I got. Also annoying, I did all this registration and crap back when they had the MkIIa firesale. They seem to have flushed their database, forcing me to enter my address and whatnot all over again, which, of course, didn't work.

I haven't yet, but it took about a day to get one when I ordered my Empeg, which is the only other thing I've ever ordered from Sonic Blue. I also believe that it says it will take 24-36 hours to ship somewhere on the website.

I'm on the phone with support right now checking the status. I called the number on this support page for the Rio support and got an answering machine for Buddy at P's Plumbing. Interesting...

I then called the support number for the Rio Central from another page and he assured me that was the support number for Rio. Of course I have now found the right number but it's just interesting to note that Buddy has a number on SonicBlue's website.

I'm sorry, but I just have to laugh at this whole concept. SonicBlue just barely was able to deliver on orders that people paid legitimate prices for... You guys somehow thought they'd be able to handle the orders that you paid $0.01 for? I'm not knocking you for trying, but some people are drifting way past "it would be kinda cool if..." into the territory of "If they don't deliver, I'm going to...." and that's just not reasonable thinking. Beyond SonicBlue's consistent lack of effort in ensuring adequate order fulfillment and pre-sale customer service, there are clear precedents for companies being very much in the right if they decide to cancel mispriced orders.

In other words, nice try, fellas, but get over it.

Yeah, that's kind of been my feeling right along too. Though I'm interested in what the laws regarding this type of thing are, I'd never make a big stink over not getting my penny's worth.

To be honest, I considered at first that this might be an actual legit pricing to dump inventory. Of course that was right after I'd woken up and hadn't fully come to grips with reality. After a nice shower and looking at other prices on the website that weren't reduced, I decided it must be a mistake (duh!).

Something similar happened with some ipaq's recently on another website.

It depends on the wording of the confirmations, whether on the site or by email, and the exact pricing mishap.

I ordered a Kodak DX3700 for £100 last year - normal price was apparently £380. After a big hoohah and test case they offered them to everybody at that price. Personally I think the camera is just about worth £100 but it's nice to have a second camera to carry around without worrying about losing/damaging it:

The key points were:

1) The price wasn't stupidly low, and it had "SPECIAL OFFER" in red next to the price.
2) The confirmation emails talked about a contract and your rights to cancel the contract and keeping the email as a proof of purchase.

Yeah, I remember that. Eventually they offered me (and everyone else) the camera at ~£100. To be truthful I didn't feel it was really worth it but more importantly I fealt guilty 'scamming' Kodak. I mean, I *knew* it was a mistake and morally I would never have been comfortable owning the thing knowing I had burned Kodak in order to get it, irrrespective of the consumer laws in force. Ok, there's something to be said for 'avenging big corporations' but I think even that's misguided.

I have worked on frontline tech. support and plain old customer support. It's quite an education (as I am sure a lot of us here know already), you never hear when you('re company) get it right but you always hear when it's wrong. Harry home user is on a quest against the enemy and here in the UK his rights are always improving in his favour. In principle I'm not against this since most of the new consumer rights are there to legitimately protect the consumer against unscrupulous sellers. But, it apparently sets a precedent that encourages Harry home user to embark on a crusade on behalf of all of his unknown allies when he gets a swipe at BigCo.

In my experiences BigCo is less likely to do something unscrupulous than LittleCo is. Employees at BigCo probably have nothing to gain from a perceived ripoff and whatever it was was probably accidental. Conversely I have worked for LittleCo where the opposite applied. The major difference is that LittleCo will tell him to piss off (in those words) and Harry home user will tuck his tail between his legs and oblige. When it's BigCo the opposite happens because Harry is on his crusade and he knows there is a long chain of command he needs to work his way through in order to realise his opportunity to treat. Often he know's he's being a pratt but the corporate regime prevents anyone actually telling him this (LittleCo would have told him this long ago and nipped it in the bud there & then).

I work for a BigCo and on a hurried Friday afternoon I once accidentally entered the quantity available into the price field on our web store admin module. In effect, we were advertising 17" monitors for £37.
On the Monday we had (fortunately only) sold 15 of these monitors. To cut a long story short, we chose to honour these orders and the impact was (fortunately) bearable by my business unit. The thing is though; while Harry home user thinks he is on a quest against a large company, in fact (in my case anyhow) he is working-over a finite autonomous unit within the big corporation. Essentially it's a small business operating within a bigger one. In my case it was trivial, but for Kodak it was far less I would imagine. The damage is real and quantifiable, people likely lose jobs and all of that bad stuff.
At the end of the day though, I'd imagine that a single employee entered something somewhere in good faith (MyCo, SB, Kodak, Currys, Amazon etc.) with neither that employee nor the employer having any intention of causing anyone any harm or stitching anyone up, it's a simple human mistake and we are all of course.......

I understand that Currys got off the hook from shipping £0.01 TVs because it was determined in the courts that this was considered by Harry home user as an opportunity to treat - meaning that anyone placing an order for a £0.01 TV would be reasonably expected to know that it was a mistake by the seller and the contract shouldn't be honoured.

In short, I hope SB have the common sense not to ship these units (not that I wouldn't want one myself!).

However, having seen the Sonic Blue Store (no relation to the folks @ empeg specifically), nothing would surprise me.

I have been fortunate to actually have success dealing with their store support in the past - my orders have all been complete, accurate and price guarantees honored. But, if this board is a valid sampling, I am one of the very few that can say this.

Trust me, being a fish in an autonomous unit inside another autonomous unit inside a rather large (even after multiple spinoffs) company, I know exactly what you mean about big business being less likely to actively try to <expletive deleted> a customer. But the sheer inertia and confusion involved with that kind of big business can make it very unresponsive to individuals.

I don't think anyone here is really out to get Sonic Blue. Well, maybe their e-store, since many others have had difficulties with them in the past. But on that 1 in 1,000,000 chance that they actually ship the units, it can't hurt to put in the request. Kind of like buying a lottery ticket - you know that you will not win, but people do it anyway.

Okay. I am calling with one of my two order numbers to see what they tell me. More to follow in an edit. I have already spent the first cycle of hold time and spoken to a live person, so I hope to have more data, propaganda, confusion, smoke and/or mirrors soon.

Edit 1: They couldn't find my order number either, but they are at least looking for it. On hold for another cycle. More to follow.

Edit 2: They still couldn't find it. They took a little extra data (email address, product ordered, contact information) and are "escalating it" to their order processing department. I am supposed to receive the results of that query within 24-48 hours by email. At this point, I would assume that all orders taken for the Rio Central are in a strange "limbo" state - not on their system. As I hear more, I will post it.

Note: I only gave them one of my two order numbers, in case they decide to cancel that order number. But, given the weird state these are in, I still really doubt that any will reach shipping...

#1 - Gave info... put on hold....

#2 - Could not find it in their database... asked for my login and password for the site to check my order... said it showed as processing, put on hold again. Don't think they'll like the $18.03 charge they see on there. On hold....

#3 - Says they can't find any record of it and thinks it may have been cancelled... she's escalating it to see whats up with it. Got a case number for it. Yeah... I think we're not getting them. It was fun while it lasted.

I never really thought I'd spent anything, though, and I'm not going to use my $25 certificate. Still, it was fun!

Honestly I'm sort of glad it didn't work out. I think I would've felt bad taking a 100,000% discount.

Yeah I got the same email. I've got to say I'm actually impressed that they fessed up and mailed out $25 coupons. I didn't expect anything, so $25 off is a nice gesture.

Now, of course, this leaves me in a quandry. It's a sonicblue coupon, so I figure I have to spend it now or never, which rules out applying it to a pearl. So I decide that an S10 for $60 isn't a bad deal, but that doesn't come with an FM tuner, so I should probably go with the S30 for $80. Now of course, we start talking about real amounts of money that could be applied to a pearl this summer. I guess I'll have to work this one out for myself.

I believe "Tuners, empeg, for the use of" over in main is the longest thread. You can sort any forum by any colum, so you can check and make sure there isn't a 500 post flamewar in projects that I missed...

I thought I'd bring this thread back from the dead to point on something funny I just noticed. I used my $25 coupon on the refurbished replay deal, and after reading various reports about cancelled/non-cancelled orders, logged on to check mine. At the moment, my Central order shows "processing" and my Replay order says cancelled. I've been assured by all parties that the exact opposite is true. You've got to love the eStore.
