This will probably start a pretty big thread. I just got an email from my old boss referencing this link. Dell seems to be offering the 20 GB Karma for $70.16.

I submitted my order already and with any luck, it will be here in 2 days.

My old boss says he even called Dell, confirmed the part number, features, and price, and placed an order on the phone.

Its funny that it says I'm saving $7.79, off a regular price of $77.95

The chances of it working are pretty slim. One my friends uses Dell all the time and he tells me that if they mess up the price they will not honor it.

Nonetheless, I ordered two

Let's just cross our fingers until UPS picks up the packages. I got my email confirmation (even free ground shipping). They say it takes up to 24h to process and email you an order number. Holding breath.....

Got confirmation and ship date on or before November 3?
Maybe they are not in stock. Could this be some freak promotion? Hope they are not selling them off at sell-out prices already.

I doubt it. They'd say somthing like, "save $330" if it was a promotion.

Sorry Philip, missed your post originally. Got your PM. I ordered 3.. If by chance they ship them I'll contact you about arrangements to ship one over to you. If someone in the meantime wants to order another one for you I'll keep the extra (3rd) one. Either way you'll get one.

There was a recent offer on Dell.com for a 200GB drive with two $100 rebates. Enough people bitched at Dell when they voided the offer that they ended up honoring it in the end.

OH yeahh... i forgot about that. I actually got my now mp3 storage drive out of that. hah. Took a number of calls to customer support though.

hmm... this isn't really a rebate issue though... it's a price misprint. If only a few people get it and bitch enough they might honor it, but the chances are if a LOT of people bitch on this one, it'll be a no go.

Too good to be true...

...but only available to US. Alas, I live little too North: I'm in Canada so I can't order from dell.com. But at that price, if someone can order 1 or 2 more and ship them to me, I'd be more than glad !!! I'd pay shipping and compensation for the extra trouble of shipping up here...

Sweet, I'm always up for one of these. They don't usualy come, but it's always a cheaper thril than the blackjack table. The chances of winning are probably about the same.

Free shipping if you oder over $100.

You just made me remember, during the ordering process I swear I checked a box swearing I would not ship these things out of the country. If I checked what I think I checked, I can't send any of my order out of the US. Does anyone remember the exact wording or am I just imagining this?

Dell seems to be on to this. As of ~4pm PDT, searching the Dell site for "Karma" finds the 20 and 40GB players listed. Clicking on the 20GB now gets you a "Sorry Product Was Not Found" message. Probably a tempory message until they can "re-evaluate" their pricing.

This may be good news for those who've already placed their orders. Fingers crossed!

Still doubtful it is going to happen. Hopefully somebody out there is nice to me if it does though

A while back Dell had a pricing mistake on some of their LCD monitors. The 21" model was going for half price and I think the 19" model also had substantial cuts in the price. They emailed everybody to say that it was a mistake and they wouldn't be honouring the price. As compensation they offered everybody a £100 discount from what I remember.

A 20GB Karma costs $360 on Amazon. As they're going for $70 on Dell, they're making roughly $290 loss on each one. So for a conservative estimate of around 5000 players ordered (It's not that unlikely, some people on the Anandtech forums seem to have ordered 30+ each) then that's $1.45 MILLION in losses... Even Dell doesn't have pockets that deep.

What's likely to happen is that Dell will offer the Karma at the correct price but give people a discount voucher worth $50 or so.

I was able to get in under the gun, but have not gotten a confirmation. I can't imaging Dell is going to honor this. This has been posted all over the Internet. Even if just 1000 units were ordered, that would be at least a couple of hundred thousand in lost profits for Dell.

Not that this would be worth pursuing in a legal forum, but does anyone know whether there is any legality around internet advertised pricing? I think there are some laws out there about false advertising in print, but on the internet?

At the bottom of the confirmation page, it clearly states that Dell isn't responsible for typographical mistakes regarding prices or information.

Not sure about the US but there are loads of complicated laws about it in the UK.

It all boils down to whether they've taken your money or not. If they've actually charged your credit card and received the money in their account then they should ship the item to you for the agreed price. If however they've just reserved the amount and it's currently being held by the credit card company then the transaction hasn't actually been completed yet.

About false advertising they have to show that it was a mistake and that nobody would actually believe that the price was correct. A chain called Argos advertised a TV for £0.01 once. Several thousand people bought it but Argos didn't supply the TV's in the end. A few people actually tried to sue them because of that but their case was shot down because it was obvious that the price was a mistake.

Kodak advertised a £300 digital camera as a special offer for £100. Since £100 isn't too unrealistic for a digital camera and they also advertised it as a special deal they were on shakey ground. The order confirmation email was also worded poorly and implied that the order was accepted and was being processed. In the end they decided to sell everybody the camera's at £100 each as a sign of good faith.

IANAL etc...

In case anyone is interested about how the legal system has dealt with previous cases such as the one we are currently facing with Dell, check out this article:

As I said, not that we all have enough time to sit around and sue Dell, but it makes for an educated argument when speaking to the supervising staff at Dell concerning any potential refusal to fill one's order.

My orders from Dell always state this at the bottom of the email:
"Dell cannot be responsible for typographical or other errors, and reserves the right to cancel any orders resulting from such errors."

Of course for a large company for Dell, reputation can mean everything. Legally they may not be held liable but trust of the consumer is another thing altogether. I'm curious, is there an outside chance that the 40 gb is being secretly released and the 20 gb is being dumped? (I doubt it too . Just raising conspiracy theories.) It appears you can put the 40 gb in your cart. If it's not in stock or being delivered their ordering system is very deceptive. A "sorry out of stock" should pop up to warn you that the product isn't even available yet!

Wow I got in on this one a little bit late although I think I was able to order it. As soon as I ordered it I tried to go back and add another to the shopping cart and it said "ERROR Sorry we are unable to process your request at this time. Please try again in a few minutes. If this problem persists, please come back later or call one of our sales representatives."
so who knows whats going to happen. Only time will tell

Eh. Talk about Karma... from all the days I have to stay after school, it had to be today. Oh well - good luck to all that ordered!

And by any chance, if these do come... if anyone ordered a spare, please PM me a price if you're willing to sell it. I'm poor enough as a high-school student... been saving up for a Karma. Profit for you and a good price for me.

There is one thing that I was thinking about... some of the people that ordered 3 or more, what happens if dell just bills the correct amount to your account? Getting a bill for $1200.00 would not be nice.

That, I believe, they cannot do. My credit card would just not accept the charges anyway (have a daily limit).

Yeah, they can't and won't do that. You have to authorize the amount they charge, and if they DID do that it would be suicidal... the backlash would be furious and loud i'm sure. But, that's irrelevant because i'm pretty sure that would be illegal.

Nah. Bait and switch is something else. It's when you claim that you have one thing to get people to come in and then tell them that you don't really have it and you should buy this instead. It's unethical, but not illegal, AFAIK. Well, maybe false advertising if you claimed you had something you didn't.

Ahh okay. I thought it was saying you could get something at so and so price but when you do come in, then you get charged something higher. Learn something new every day

Either way, Dell aren't going to charge the full price without checking with the customer. Imagine the outcry if they did

Speaking of people ordering 30+ units...

Have you guys looked on ebay recently?

There's quite a few 20gb Karmas on there. There's even one with a "Buy it now" for $275. Not too bad.

Looks to me like some people might actually be trying to sell 20gb Karmas, ASUMING they would be getting them from Dell for the supa cheap price.

I don't know exactly how all the laws work for online auctions, but I'm guesing that they are leagally binding. If that's true, and you were to get in there and buy one at a good price on ebay, the other party would need to caugh one up...

But then you'd prolly need to go to small claims court, blah blah blah. Might not be worth it, but I thought I'd mention it.

Ah, gotta love it. This is from the Anandtech forum, justifying why Dell should ship these all out:

What exactly is the product... well its a 20 gig hard drive, well lets see, those go for about what, $10-30 now retail. It has a databus for the hard drive, which means a controler chip, it also has usb, which again is a control chip. Well just about ever motherboard manufacturer already has chips that are combo usb contollers and ide controller, and cost less then $2. You also have a processor chip to handle I/O requests and perform the MP3, etc. decoding ($5-10). You have a few capacitors and resistors (maybe, maybe $1-3 worth). You have your pcb for all the chips with traces for all the connections ($5). A header for the usb connector ($.10), a volume dial ($.05), a 1/16" headphone jack ($.50), a battery pack ($.40), a lcd screen? (not sure but only $5 if it has one), an external power adaptor ($1-4), and the plastic outside shell ($5). So, on the high side of the components you are only looking at ~$60-70 in parts, then figure another $10 in production costs, so figure $80 to produce.... hmmm... that sure looks VERY close to what we just bought it for....

If they truly believe that you can build/develop a Karma for $80 and sell it for $400, then why don't the set up shop and show the rest of us how it's done? Surely they'd want to take advantage of something you can sell at over a 400% profit?

Speaking of people ordering 30+ units...

I suspect that Dell will cancel those orders first. The terms and conditions of Home/Home Office sales include a 'No resale' condition, and people are going to have a hard time justifying their need for 30 personal mp3 players.

They're waiting so they can ship out everything else that wasn't a karma in those orders... Or at least, that's what they're doing with mine. It's all right, I've wanted an extra AC adapter for my laptop and this way it qualified for free shipping and got 15% off.

I'm not really sure if they can.

They sent me an order acknowledgement.
They thanked me for my order.
They sent me the terms and conditions of sale which include;

This Agreement contains the terms and conditions that apply to purchases by Home, Home Office, and Small Business customers from the Dell entity named on the invoice ("Dell") that will be provided to you ("Customer") on orders for computer systems and/or related products and/or services and support sold by Dell in the United States. By accepting delivery of the computer systems, other products and/or services and support described on that invoice, Customer agrees to be bound by and accepts these terms and conditions. If for any reason you are not satisfied with your Dell-branded hardware system, you may return the system under the terms and conditions of Dell's "Total Satisfaction Return Policy", which is located online at www1.us.dell.com/content/topics/global.aspx/policy/en/policy?c=us&l=en&s=gen&~section=010 or may be found in the documentation accompanying the system.

THESE TERMS AND CONDITIONS APPLY (I) UNLESS THE CUSTOMER HAS SIGNED A SEPARATE PURCHASE AGREEMENT WITH DELL, IN WHICH CASE THE SEPARATE AGREEMENT SHALL GOVERN; OR (II) UNLESS OTHER DELL STANDARD TERMS APPLY TO THE TRANSACTION.

These terms and conditions are subject to change without prior written notice at any time, in Dell's sole discretion.

1. Other Documents. Other than as specifically provided in any separate formal purchase agreement between Customer and Dell, these terms and conditions may NOT be altered, supplemented, or amended by the use of any other document(s). Any attempt to alter, supplement or amend this document or to enter an order for product(s) which is subject to additional or altered terms and conditions will be null and void, unless otherwise agreed to in a written agreement signed by both Customer and Dell.

I don't care that the order acknowledgement included an additonal clause. Their terms and conditions preclude it.

Meanwhile, a co-worker of mine who ordered 10, has had his credit card charged for the full amount.

Now, he is the sysadmin and a regular customer with a corporate account. That may have something to do with it. We'lls ee if he actually gets anything.

odds are his card was just authorized at that amount, not actually charged. It shows on mine too, but it's not an actual charge until they are shipped.

edit: but if i'm wrong... and i get canceled... sign me up for one of those 10! hahah.

My old boss (the one who informed me about this whole thing to begin with) says he argued and bitched on the phone with Dell for about an hour, and they agreed to sell him the Archos Jukebox Multimedia Video AV 120 for the same price. He works in customer support, so he knows how to demand answers and information, be annoying, and polite all at the same time.

When I asked him how he stumbled upon the cheap Karma in the first place - he says he happened to be shopping for mp3 players at the time of the price mixup.

...mmmm...sound de-lish I just use salt and alot of pepper, preheat the grill to high, cook for exactly 3minutes on each side and enjoy.... If it's a nice thick steak I turn the grill to low to simmer for an additional 3minutes to get that nice medium temp.... mmmmmm....mmmmmmm. Glad I'm not a vegetarian.

To each his own. I mean, filets are about my least favorite cut of beef and wrapping bacon around them just makes them worse. I love bacon on its own, though.
