I dunno about England, but in the good old U.S. of A, if you're rear-ended, it's generally automatically considered to be the following driver's fault. Did you signal the turn?

Except in the event of an "unavoidable accident"... which happened to my roommate this past weekend. Rainy conditions, guy nearly tailgating him, then a 18 wheeler sideswipes him and barrels him into the concrete embankment on the left.. the guy behind him plows into him [following too closely] and destroys his car. The 18 wheeler speeds off, leaving the scene. No ticket was issued because it was "unavoidable" which is complete crap. Everyone was OK tho, but my roomie is going to get screwed now.
