I remember a while back Jobs talking about offering stuff on the iTunes store without the DRM encumberance. What's the current status of that? Our album just showed up there and I'm curious if people get the option of MP3, or if it's DRM-encumbered with the FairPlay stuff. Cuz if it is, I want that stated when I link the thing.

It's a mix. Anything shows as "iTunes Plus" is DRM free, and higher quality. Several labels still have not switched to allowing Apple to use DRM free music. Some have offered DRM free stuff through other outlets though, like Amazon, likely in an attempt to help provide competition against iTunes. To me though, it's like deciding to only sell a CD at some small chain of stores while offering the cassette version at the largest retailer.

And I found your album on iTunes, with no plus. So it's only AAC with Fairplay. You may need to say you allow them to do non DRM somehow, no idea how that works on your end though.

Even without DRM it will still be (MPEG-4) AAC. Apple never has had any MP3 files on the store.
