In this case I believe they've got the right to do so. Microsoft have been rushing everything and everybody to get it released before Christmas. It isn't ready by a long shot as evident by the huge shortages and massive showstopper bugs. I'm curious as to how they're going to patch stuff since not everybody has the HD...
